Trademark Registration Oman

We can offer you all the services relating to trademarks from the beginning until the receipt of the registration certificate, appeal and opposition, litigation, advisory, trademark prosecution and defense. You can rely on our expertise and practical know-how when prosecuting, and defending, trademark infringements, passing-offs, unfair competitions and anti-counterfeiting proceedings. Our trademark consultant Oman services include carrying out due diligence investigations, negotiating, drafting transactional documents and IP security arrangements.

 

Trademarks law issued by Royal Decree No. 67/2008 dated 4/5/2008, and becomes effective after published in Official Gazette No. 863 issued 18/5/2008.

 

Registration Procedures:

  • Multiple classes are not accepted to register trademark, one class for each application.
  • Classification of goods / services: 10th Edition of Nice Classification.
  • For search in Trademarks Office it takes 2 to 3 working days.
  • From the filing day, it takes from 3 to 4 months to receive the decision from the Trademarks Office.
  • We have 60 days from the date we received the decision (refusal or acceptance) to proceed with the next step.
  • If it is refused, we have to file appeal in the Trademarks Office or in court. It takes two to three months to issue appeal decision.
  • If it is acceptance decision, we pay the official fees for publication in official gazette and to  one of the daily newspapers.
  • Upon publication in the Official Gazette and daily newspapers, a 90 days opposition period is counted as from the publication date.
  • After the 90 days opposition period has expired and no opposition has been filed, the trademark is finally registered; however, it usually takes three months for the Trademark Office to issue the Registration Certificates.
  • The entire cycle of application usually takes 15 to 18 months from the filing date.
  • A trademark registration is valid for 10 years as of the date of filing the application.

Filing Requirements

1. Power of Attorney duly notarized & legalized up to the Consulate of  Oman or to be Apostille if the applicant’s country is a member of Apostille Convention. One power of attorney is sufficient in filing any number of applications in the name of the same applicant. (Late submission of the POA is applicable within 60 days as from the filing date with penalty for late filing documents).

2. Copy of the Certificate of Incorporation of the applicant’s company (with an Arabic translation). For individual application, the applicant must submit trade license, individual institution certificate or commercial certificate in the applicant’s name.

3. A certified copy of the priority document, if priority is claimed (with an Arabic translation).

4. Soft copy of the trademark.

Requirements for Renewal Trademark:

Renewable for similar periods (10) years, the renewal fees of a trademark registration can be paid during the last six months before the expiry date.

1. A Power of Attorney notarized and legalized up to the Consulate of Oman, if we are not the agents in the Trademark Office records.

2. The trademark registration number and Class, preferably a copy of the Certificate of Registration.

 

Requirements for Assignment Applications:

1. Power of Attorney from the assignee notarized and legalized up to the Consulate of Oman or Apostille

2. A certified (or notarized) copy of the Certificate of Incorporation of the assignee (with an Arabic translation).

3. Deed of assignment executed by the parties, legalized up to the Consulate of Oman or Apostille.

 

Requirements for Registered User/License Application:

1. Power of Attorney from the licensee notarized and legalized up to the Consulate of Oman or Apostille.

2. A legalized copy of the license agreement executed by both parties.

3. A simple copy of the registration certificate of the mark.

 

Requirements for Merger:

1. A Power of Attorney legalized up to the Consulate of Oman or Apostille.

2. A certified (or notarized) copy of the Certificate of Incorporation (with an Arabic translation).

3. A certified & legalized copy of the merger document (with an Arabic translation).

 

Requirements for Change of Name:

1. A legalized Power of Attorney in the new name or Apostille.

2. A certified (or notarized) copy of the Certificate of Change of Name.

 

Requirements for Change of Address:

1. A certified (or notarized) copy of the Certificate of Change of Address.
